Eminent Domain / Condemnation

Wilmington North Carolina Eminent Domain / Condemnation Law Firm

Defending your Property Rights

Whenever the government takes your property for public use, you have the constitutional right to fair and just compensation. As you can expect, the amount that you may be entitled to or want is sometimes quite different from what the State or other condemnor is willing to pay. At Lea, Rhine & Rosbrugh, P.L.L.C., we can protect your rights and help you get just compensation for the loss of your property.

We handle most every type of eminent domain case, including:

Two types of "Takings" exist that we can discuss with you:

Full Taking- In the course of a full taking, the government or other condemnor takes the entire property and the land on which it sits.

Partial Taking- There are different types of partial takings. Some take some of the land, but leave the buildings intact. Others impose an easement, such as a throughway, that cuts through the property. In these situations the amount of money you are entitled to receive is: The Fair Market Value (FMV) of entire tract minus the FMV of remainder of the land you will retain after the condemnor takes what they need. This amount will be offset by any special or general benefits resulting from utilization of part taken for highway purposes, etc.

Our eminent domain lawyers handle all types of takings cases. We employ credible and reliable experts to present your case, both in the negotiations and at trial, if necessary. In the case of a partial taking, we determine how much the easement or land appropriation is going to depreciate the value of your property. We focus on the relocation assistance you are entitled to and the other amounts that can be overlooked.

We work on a contingency fee basis which is computed on the difference between the amount received via settlement or verdict and the deposit. If engaged prior to the deposit being set and the case settles, then we will work on an hourly basis. If the case does not settle, then we work on a contingency fee basis where we must get you more then you were offered in order to receive an attorney fee. However, all expenses must paid by the client.
